1. OBJECTIVE
1.1 The aim of this policy is to describe the process we will take ON the occasion that any of the sports events booked through Disfruta Sports Tours are cancelled or postponed due to Coronavirus Disease 2019 “COVID-19” virus.
1.2 This policy is susceptible to changes with the introduction of additional governmental guidelines and will accordingly be updated if, and when, required.
2. APPLICATION
This policy includes measures being taken to ensure that the client receives fair cancellation, postponement and/or refunding accordingly, due to the impact of COVID-19 pandemic.
3. ACKNOWLEDGING DISFRUTA SPORTS TOURS CANCELATION POLICY
3.1 As per our terms and conditions: If the Client cancels the booking –
3.1.1 more than 60 (sixty) days prior to the Final Payment Date, Disfruta shall refund the Deposit paid in terms of clause 2 above, subject to any fee which Disfruta becomes liable to pay to any third party as a result of the Client’s cancellation; or
3.1.2 60 (sixty) days or less prior to the Final Payment Date, Disfruta shall be entitled to retain the Deposit as a cancellation fee.
3.2 It is hereby recorded that, in the event of the death or hospitalization of the Client, Disfruta shall not impose the cancellation fee in terms of clause 1.2, however Disfruta shall be entitled to retain any amount required to cover its loss in respect of any booking made and/or cancellation fees payable by Disfruta on behalf of the Client, subject to receipt of one of the following –
3.2.1 In the event of death of the Client, a certified copy of the death certificate of the Client; or
3.2.2 in the event of hospitalization of the Client, an original medical certificate issued by the Client’s medical practitioner stating the date on which the Client was hospitalized and the date on which the Client was discharged, as the case may be.
4. COVID-19 PROCEDURE
4.1 We will ensure that we will keep you updated with all communication from the event organizers, for any event that is affected by the COVID-19 pandemic.
4.1.2 For any flights booked via Disfruta Sports Tours, we will issue refunds or date changes subject to the terms provided by the airline.
4.2 In the event of Cancellation of Event, following options may apply subject to the event organizers:
4.2.1 Voucher given for a future event or a partner event.
4.2.2 Race entry carry over to the following year.
4.2.3 Race cancellation with no refund.
4.2.4 Race cancellation with refund.
4.2.5 Where no race refund is issued, Disfruta Sports Tours will calculate a refund as follows:
Account balance less entry fee, less flights.
4.2.6 Where a race refund is issued, Disfruta Sports tours will calculate a refund as follows:
Account balance less flights
4.3 In the event of Postponement of Event, Disfruta Sports will move all tour plans to the new date.
4.3.1 Should there be further costs incurred, Disfruta Sports Tours will communicate any changes before confirming booking for the client
4.3.2 Should clients not be able to travel on the new date, following refund calculation may apply subject to the event organizers:
4.3.2.1 Race cancellation with no refund – Account balance less entry fee, less flights
4.3.2.1 Race cancellation with refund – Full account balance, less flights.
